America's involvement in the International Criminal Court - while helping to facilitate a broader spectrum of accountability across the globe where the International Court of Justice leaves off - creates a vacuum of vulnerability too evident to ignore. From checks and balances to due process to the exclusion of certain offenses that most definitely belong but are somehow protected, these troublesome inconsistencies provide the United States with a solid foundation upon which to stand apart from the Court involvement.
